TERMS AND CONDITIONS
About the area
Our accommodation is in the village of Mount Victoria, the highest point of the NSW Blue Mountains. This is an area where native plants and animals are common. When outdoors, guests should wear appropriate clothing and footwear, be mindful of debris on the ground, and not approach or disturb wildlife. As this is a bushfire-prone area, outdoor fires are strictly forbidden.
About Kanim
Located on a sealed road approx. 1.5 km from the village centre, the property consists of a 600m2 unfenced yard featuring native bush and terraced garden beds. The yard to the rear of the house falls sharply, before a sheer 100-metre cliff – for this reason the rear yard is strictly off limits.
The driveway is sealed with parking for two cars. A short pathway, which includes stairs, leads to the house. People with limited mobility may not find this easily accessible.
Entry to the house is at the middle floor where there is one bedroom with two single beds, a queen bedroom, a bathroom and laundry. The kitchen, living and dining areas are down half a flight of stairs. Two master bedrooms, each with a queen bed, and spa bathroom are up a full flight of stairs.
General use and safety
- The property is for holiday accommodation only and not for events, parties, or any commercial activity
- Children under the age of 18 must be supervised by an adult at all times whilst on the property
- Pets are not permitted under any circumstances without prior written permission
- The rear yard at Kanim, Mount Victoria is strictly off limits
- No smoking inside. Smokers may smoke outside; cigarettes should be disposed of safely
- Outdoor fires are strictly forbidden
- Furniture must not be moved, appliances must not be disconnected or reconfigured
- All furniture, fixtures and household contents, including kitchen & cooking utensils, appliances, equipment, maps, guides, brochures etc. must not be removed from the property for any purpose
- Guests must secure the house by locking all doors and windows whenever the house is unattended
- Entertainment/Music/Enjoyment is expected, but you agree to respect our neighbours’ right to enjoy peace and quiet; Noise levels must be minimised after 9PM weekdays or 11PM weekends, or immediately upon request of neighbours, management or authorities
- Appliances, including fireplaces, must be turned off when unattended, and must not be controlled by children
- Objects must not be placed on or within 1 metre (3ft) of the fireplace or heaters
- All accidents or breakages must be reported immediately by texting +61 433 761 290. We reserve the right to charge for breakages
- Guests agree to follow all reasonable instructions by management, police or other emergency services
- In the event of an emergency, Police, Fire & Ambulance can be contacted by dialling ‘000’ from your phone and notify management by calling +61 433 761 290.
Check In / arrival
- Check in is strictly from 3.00PM, unless otherwise agreed in writing, prior to arrival
- Check in is via keypad access. We will provide an access code prior to your arrival
- We welcome your privacy but are available for assistance during your stay. Please phone or text us with any access issues
- If anything is not working/not to your satisfaction, report immediately by calling/texting +61 433 761 290.
Check Out / departure
- Check out time is strictly 11AM, unless previously agreed in writing, prior to arrival
- The house should be left in a clean and tidy state, including the BBQ
- Load dirty dishes and run the dishwasher
- Put food waste and rubbish in the bins outside
- Check you’ve got your belongings
- Close and lock all windows
- Lock the house.
Proof of identity, security deposit, additional charges
- Proof of identity* and registration numbers for all vehicles are required for all bookings
- A security deposit/bond of $250 is required for all bookings. Higher deposits may apply
- We reserve the right to deduct from the security deposit, costs related to any of the following:
- Cancellation fees (see item 5 ‘Cancellations’)
- Any food, beverages or other consumables that are clearly priced (e.g. Coffee pods)
- Damage to the property caused by you, your guests or pets, whether intentional or accidental
- Damage to, or loss/theft of, contents, furnishings, fixtures and appliances caused by you, your guests or pets, whether intentional or accidental
- Excess cleaning fees – the house must be left clean and tidy; dishes must be rinsed and stacked in the dishwasher; all perishables placed in the council bins (at the top/side of the driveway) on departure
- Barbeque (BBQ) cleaning – it is your responsibility to thoroughly clean the BBQ after use. A $25 fee will apply if the BBQ is not adequately cleaned
- Call-out fees charged to us by maintenance workers when they are unable to access the property as a result of your failure to check out on time
- Any other reasonable charge to cover out-of-pocket costs resulting from misuse of the property or belongings, or any breach of these terms or house rules
- In the event that costs for any of the above exceed the amount of the security deposit:
- We will provide written notice giving seven days to pay the outstanding amount
- Failure to pay may result in legal action to recover costs, including our own legal expenses
- We may report any unpaid amounts to credit reporting agencies
- Any intentional, careless, reckless or negligent act of disturbance, damage, loss/theft will be reported to the police, and criminal and/or civil prosecution may be pursued
- We will supply a written summary, and supporting evidence where necessary, of all additional costs.

* Acceptable Photo ID is a current (non-expired) Australian Drivers License, Passport or other government-issued identity document. We will not use or share your personal information for any purpose other than for verification of identity. Copies, including electronic copies, will be destroyed upon satisfactory inspection of the property by our maintenance team on the day of departure.
Cancellations
- Bookings cancellation policy as per the terms through Airbnb or HomeAway Stayz
- No refunds will be paid in the case of premature departure (any time after check in) – all amounts paid are forfeited
- In the event that we are unable to supply accommodation because the house is not fit for habitation – either because of damage from flood, fire, storm, accident or vandalism, or because authorities have ordered an evacuation of the immediate area at the time of your stay due to the imminent threat of a civic emergency or natural disaster (e.g. a bushfire) – we will reschedule the booking without penalty
- Any breach of these terms by you or your guests will result in the immediate cancellation of your holiday tenancy without any legal right to a claim or refund.
Date changes
Once you’ve paid, your booking is confirmed. If you need to change your booking dates, we’ll immediately re-list your original dates and book the new dates. If we rent your original dates for equal value, the full amount will be credited to your new booking. If we’re unable to rent your original dates, a Change Fee will be deducted from payments received:
- MORE THAN 28 days before the arrival date = AU$75 or 12.5% of the tariff (whichever is greatest)
- WITHIN 28 days of the arrival date = AU$250 or 50% of the tariff (whichever is greatest).
Inspections
- We reserve the right to inspect the property at any time, without notice, if we have reason to believe there you have breached any of our terms or House Rules, or if there is an emergency
- We reserve the right to access the property to undertake outdoor work such as grounds maintenance, stocking of firewood etc.
- We may send an agent or representative to attend the property or trade professional if repairs or maintenance are required.
Reviews
- We agree not to make negative reviews of guests without first notifying guests of any issue, and providing seven days to rectify

Liability
- The property owners, their agents or representatives cannot be held responsible, nor legally liable, for any loss, injury or death, whether accidental or otherwise, that occurs as a result of:
- Any outdoor activity you or your guests undertake, including but not limited to swimming in dams or creeks or hiking/bushwalking
- You or your guests not exercising proper care or judgment, or taking reasonable precautions, to ensure personal safety and the safety of your property
- You or your guests not following the instructions of management or any other authorities
- Any act of vandalism or violence perpetrated by you, any of your guests or any third party
- Any act of God or war
- Any unforeseeable event or act
- Any breach of these terms or House Rules by you or your guests
- It is your responsibility to consult with a licensed insurance professional to ensure that you have a suitable type and adequate level of travel, medical or other insurance(s) to cover out-of-pocket expenses, loss, injury or death resulting from any incident, accident, emergency or any event beyond our control
- We make every effort to ensure that information available on websites, in brochures and other material is current and accurate; however, we do not guarantee it
- We cannot be bound by any offer or term, other than other what we offer or represent to you in writing.
Changes or amendments
- These terms may not be changed, altered or modified by any means other than in writing
- These terms may be changed at the Home Owner’s discretion by notifying you in writing no less than 30 days before the change takes effect
- Requests to reschedule dates are accepted at the Home Owner’s discretion; such requests are subject to availability and may attract fees consistent with the above cancellation.
Acceptance
- Making payment is like signing a contract – your acceptance of these Terms is confirmed when you make a payment. Do not proceed if you do not agree to the Terms
- Acceptance of these terms and our House Rules is made by you on behalf of ALL of your guests.
